I. EAAP Members Area

The EAAP Members Area (the “Members Area”) is the restricted area for EAAP members (the “Member” or “Members”). It is a social network owned and managed by EAAP.

It is a place aimed at meeting other Members in order to share ideas and materials, and to organize discussions, meetings and conferences. It allows to create and subscribe to groups, and to connect with other users through a private chat.

Once connected, the Member will be provided with a personal dashboard that allows to decide which information to share with other users and which to keep private. The shared or uploaded contents that are labelled as public content are accessible to each Member but Members can also decide to limit the sharing of their information to their connections or to keep them private thus forbidding the access to other Members.

Access to and use of the Members Area are subject to an annual paid subscription for those who are not part of a Country Member while for the rest it is free of charges. Paying Members receive automated notifications when renewal is due. The Members Area permits access to protected resources, such as newsletters, publications, videos recoded during virtual meetings.

Push notifications can be sent by EAAP at the Members’ email address. Members can manage the notifications they are willing to receive.

II. Members Area use

These Terms and Conditions administer your use of the Members Area. By using our Members Area, you accept these Terms and Conditions in full (including the Privacy Policy and the Cookie Policy).

By accepting these Terms and Condition you agree to use the Members Area for the sole purposes related to your membership of and subscription to EAAP.

You are prohibited from violating, or attempting to violate, the security of our Members Area. Violations of the security of the Members Area include, without limitation, the following:

– Tampering, hacking, modifying or otherwise corrupting or breaching security without proper authorization;

– Transmitting or uploading material that contains viruses, Trojan horses, worms, time bombs or other computer programming routines or engines with the intent or effect of damaging, destroying, disrupting or otherwise impairing a computer’s functionality or the operation of the Members Area;

– Interfering with, intercepting or expropriating any system, data or information.

III. Members Area content and liability

The views expressed on the Members Area represent the views of the author(s) of the relevant message only, and do not represent the views of EAAP. To the extent permitted by law, EAAP shall have no liability whatsoever with respect to the content of the Members Area or its use.

To the extent permitted by law, EAAP shall not be liable with respect to the use and content of third-party content or user generated content accessible in the Members Area. Third-party content as well as user generated content are subject to the liability of their author(s)/owner(s) only. EAAP undertakes to delete links and any other kind of content (including but not limited to photos, research papers, message expression of hate speech or content whatsoever which is deemed to fall outside the scope of EAAP areas of interests) if it learns they actually lead to illegal information or activities.

The information available on the Members Area is offered for informative purposes only and cannot be relied upon as professional advice of any kind whatsoever, including but not limited to the expert opinions published or referred to on the Members Area.

You agree that use of any information obtained via our Members Area is at your own risk, and EAAP shall not be liable for any decisions taken on the basis of this information.

Whilst EAAP does its utmost to ensure the content of the Members Area is not in breach of any applicable law, such as copyrights law, and to overview the accuracy of the content, EAAP does not offer any guarantees about the content and information uploaded and/or shared by its Members towards the Members Area.

To the extent permitted by law, EAAP shall not be liable for any damage resulting from your direct or indirect use of this Members Area or its content or for any damage resulting from interruptions to the Members Area’s online services owing to technical errors, viruses or any (other) factors beyond EAAP’s control.

To the extent that any content on the Members Area shared or uploaded by a Member that was provided by a third party (such as an external expert) is unlawful, EAAP undertakes to react promptly to remove or render inaccessible such content upon being made aware (with adequate evidence) of the unlawful nature thereof.

Each Member, regardless of the qualification acquired (simple user, moderator, organizer), is subject to these Terms and Conditions. The group’s moderators and the meeting organizers are entitled to invite other people to join the activities organized by them on the Members Area’s group and through the Members Area’s features. To the extent permitted by the law, EAAP shall not be liable with respect to the content shared or produced in these occasions.

IV. Intellectual property rights

Without prejudice to the rights of individuals or works quoted in articles, EAAP owns the intellectual property rights in the Members Area and content and materials on the Members Area (including without limitation all images, logos and text).

You may not use any Members Area content in any manner whatsoever for defamatory purposes or for any other unlawful purpose.

VII. Changes

EAAP reserves the right to modify these Terms and Conditions at any time and without notice. Changes cannot be retroactive. Your continued use of the Members Area after EAAP publishes changes to these terms means that you are consenting to the updated terms as of their effective date. If you object to any changes, you may unsubscribe from the Member Area while preserving your EAAP membership.

VIII. Severability

If any part of the Terms and Conditions should be found invalid or unenforceable, for any reason whatsoever, the remaining parts of the Terms and Conditions shall remain valid and enforceable as if the invalid or unenforceable provision had not been included therein.

IX. Applicable law and competent courts

These Terms and Conditions of the Members Area are governed by and interpreted with Italian law, and the courts of Rome (Italy) shall have sole and exclusive jurisdiction over any disputes relating to the Terms and Conditions, the Members Area or its use or content.
